Two Types of Spousal Support
Spousal support is based upon financial need and can be awarded in two types of situations. Temporary spousal support is awarded during divorce proceedings, and often reflects a spouse’s need for support during the pendency of the lawsuit. Permanent spousal support is granted to a spouse who is not be able support himself or herself financially. In most situations, the spouse who is receiving spousal maintenance may receive it for no more than ten years depending on the length of marriage. If the spouse is disabled or is the caregiver of a special needs child, spousal maintenance may continue indefinitely.
What Factors are Considered in Determining Spousal Maintenance?
The courts consider many factors when making a spousal support determination.
